Preamble
Steffen Knoedler, Rothschildallee 41 - 60389 Frankfurt am Main - Germany, („Provider“) provides Photobooth Free and related services.
The users are referred to as “Users”.
§ 1 Scope
1.1 The Provider offers services in connection with Photobooth Free exclusively on the basis of this Terms of Service (“TOS”).
1.2 The rules and guidelines for using Photobooth Free are published on the website in the applicable, current version. Users accept these rules by using Photobooth Free.
1.3 This TOS does not apply to services of third persons, including the connection to the internet.
§ 2 Details of the services
2.1 The Provider enables the Users to use Photobooth Free and the related additional services within the existing technical and operational framework.
2.2 The Provider makes Photobooth Free available as a free web application accessible through standard web browsers on desktop and mobile devices.
2.3 It is the User's responsibility to set or maintain their device in a condition that enables the use of Photobooth Free. This includes in particular ensuring that the device is connected to the internet, has a functioning camera, and fulfills the minimum system requirements of a modern web browser.
2.4 Photobooth Free is provided free of charge. No payment, subscription, or in-app purchase is required to use any feature of the application.
2.5 Photobooth Free may be continuously updated, modified and further developed. The right to use only applies to the respective current version. The Provider reserves the right to restrict, change or cease the operation at any time without giving any reasons. Further claims of the User are excluded, unless explicitly stated otherwise within this TOS.
§ 3 User
3.1 Photobooth Free is available to all users without registration or account creation.
3.2 By using Photobooth Free, the User accepts this TOS.
§ 4 Photo Booth Feature
4.1 Photobooth Free provides a photo booth feature that allows Users to capture photos using their device's camera directly in the web browser.
4.2 All photos are captured and processed entirely locally in the User's web browser. No photos are uploaded to or stored on any server operated by the Provider.
4.3 Users may download captured photos to their device. Downloaded photos are under the User's full control and responsibility.
4.4 The User is solely responsible for the content of photos captured using Photobooth Free. The Provider has no access to, control over, or liability for photos captured or downloaded by Users.
§ 5 Terms of use
5.1 Photobooth Free is provided to the Users only within the contractual scope.
5.2 The User is not authorized to use software, measures or mechanics in connection with Photobooth Free that can disturb or modify the functionality or the course. The User may not carry out measures that lead to an unacceptable or excessive load of the technical capacities of the Provider.
5.3 The User is not authorized to add elements to the software or to modify or delete elements of the software in any way, unless authorized explicitly by the Provider in written form. In particular, the User is not authorized to copy, extract or use graphical elements or to decompile the source code.
5.4 The use serves the purpose of personal photo capturing and downloading only. The User is not permitted to use Photobooth Free for commercial or illegal purposes.
5.5 Furthermore, the User is obliged to observe the legal regulations, in particular not to use Photobooth Free to capture or distribute pornographic, racist, sexist, offending, glorification of war or violence or other unlawful content, as well as content that is capable of violating the rights of third persons.
§ 6 Intellectual Property Rights
6.1 Photobooth Free and the content of the corresponding website are exclusive property of the Provider or the respective licensor. Any unauthorized distribution, copying, reproduction or any other violation of intellectual property rights are subject to criminal and civil prosecution.
6.2 Photos captured by Users through the photo booth feature belong to the respective User. The Provider claims no rights over photos captured by Users.
§ 7 Data Protection
The Provider commits himself explicitly to the protection of user privacy and respects the applicable data protection laws for data processing. Further information can be found in the Privacy Policy on the website of the Provider.
§ 8 Specification / Defects
8.1 The Provider provides access to Photobooth Free in the respective version. Users are not entitled to claim maintenance or procurement of a specific function or functionality. Users are aware and acknowledge that Photobooth Free can never be completely free of any defects, like any software. Therefore a defect is only given if the usage is severely impaired.
8.2 The Provider does not grant any guarantees (“Garantien”).
§ 9 Liability
9.1 The Provider is not liable for damages other than damages caused by gross negligence or intent.
9.2 The preceding limitations of liability do not apply to the liability for harm of life, body and health or in case of the adoption of a guarantee by the Provider. The product liability in terms of the German Product Liability Act (“Produkthaftungsgesetz – ProdHaftG”) remains unaffected.
9.3 The obligation for compensation of damages caused by negligence of essential, contractual obligations is limited to the foreseeable damage. The foreseeable damage is limited to EUR 50.00 per User.
9.4 The preceding limitations and exclusions of liability also apply to the liability of employees, coworkers, representatives and vicarious agents of the Provider.
9.5 Any liability exceeding the liability as set out in this section of the TOS is excluded. This applies to all claims for violation of contractual obligations and tortious acting.
9.6 The Provider is not liable for photos captured or downloaded by Users, including their content, use, or distribution. Users are solely responsible for ensuring that their use of captured photos complies with applicable laws, including privacy and image rights of individuals appearing in photos.
§ 10 Amendment of this TOS
10.1 The Provider reserves the right to amend or expand this TOS at any time with effect for the future, if this appears necessary and does not discriminate against the User in bad faith.
10.2 It is recommended to Users to inform themselves regularly about the current state of the TOS.
§ 11 Final Provisions
11.1 Should any provisions of this TOS be held to be or become invalid in whole or in part, the validity of the remaining parts of this TOS is not affected.
11.2 In case the User transfers his residence or legal domicile outside of the Federal Republic of Germany, the legal venue is Friedberg (Hesse), Germany. This also applies, if the residence or legal domicile of the User is unknown at the time of a possible filing of a complaint.
11.3 The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/odr. Steffen Knoedler is neither willing nor obliged to participate in a dispute resolution procedure (including online dispute resolution and alternative dispute resolution) before a consumer arbitration board.
11.4 The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods, to all claims on basis of this TOS or in connection to it.
